DEMOCRAT AND CHRONICLE A.M. DIGEST Security firm to pay back wages A private security-guard firm that provided detention officers to the federal detention facility in Batavia has been ordered to pay $884,353 in back wages to 86 employees. The 1 Barbosa Group, based in Houston, misclassified the workers from April 1998 through January 2000, Michael Fitzgerald, assistant district director of the U.S. Labor Department's Wage and Hour Division in Buffalo, said yesterday. The 86 were labeled "guard 2," a title for employees who protect buildings and property, instead of detention officer, a position that pays $3.39 an hour more.

The company also failed to pay premiums on health insurance coverage for 10 months and paid workers straight time instead of time-and-a-half for working more than 40 hours a week, the Labor Department said. The workers have been paid a total of $228,984 for those violations of federal law. Man charged with DWI death GENESEO A Dansville man was charged with second-degree vehicular manslaughter and drunken driving yesterday as a result of a fatal car accident in October. After a lengthy investigation, the Livingston County Sheriff's Department determined that Roger Simpson, 33, of Blank Hill Road was the driver of a car that crashed Oct. 21 in Ossian.

Kenneth Dudek, 30, of Ossian died in the one-car accident on Canaseraga Road. Simpson was also charged with driving while ability impaired by drugs and driving at an unsafe speed. Bond was set at $10,000. Student hits bus; two teens hurt YORK Two teenagers were injured yesterday when a car struck the back of a stopped York Central school bus. The accident happened about 2:45 p.m.

on Route 36. Eugene McMaster III, 18, of 2358 Linwood Road, Linwood, Livingston County, told deputies he dropped his cellular phone while driving and was reaching to get it when his car hit the bus. He was not injured. McMaster is a York Central student. A passenger in his car, Justin Levey, 18, of Wheelock Road, Leicester, Livingston County, was taken to Noyes Memorial Hospital in Dansville for a minor head injury.

His condition was not available last night. A student aboard the bus, Ashley J. Scutt of Telephone Road, Le Roy, Genesee County, was taken to Genesee Hospital for shoulder pain. Her condition was not available. The bus driver said he had stopped to let off passengers and had activated the bus's lights when the bus was hit.

McMaster was ticketed for failing to stop for a school bus. He will appear in York Town Court at a later date. Police arrest two at marijuana bust YATES Two large-scale indoor marijuana operations were seized yesterday by members of the Orleans County Drug Task Force and the U.S. Drug Enforcement Agency. Arrested were Alexis I.

Mackinnon, 24, and Zachary R. Lindner, 25, both of 1162 North Lyndonville Road. Both were charged with intent to distribute and conspiracy, both federal felonies. Law enforcement officials used a warrant to search the men's house about 7 a.m. Police rounded up 18 pit bulls that were loose in the home.

In the basem*nt and in a barn, police seized about 150 marijuana plants, more than 10 pounds of marijuana, scales, packaging material and other paraphernalia. Couple injured in truck crash NORTH DANSVILLE A Wyoming County couple was injured yesterday, the woman seriously, when their van was struck by a tractor-trailer that jackknifed on Interstate 390. Louis J. Chastek, 88, and his wife, Sophie L. Chastek, 86, both of Cummings Avenue, Silver Springs, were taken to Noyes MARCH 28, 2001 Memorial Hospital in Dansville with undisclosed injuries.

Sophie Chastek later was flown to Strong Memorial Hospital. She was listed in guarded condition in the intensive care unit. Louis Chastek's condition was not available. The accident happened about 11:40 a.m. near Exit 4 on Interstate 390.

Witnesses told Livingston County sheriff's deputies that the Chasteks' van entered 390 southbound and pulled into the path of the tractor-trailer, which tried to stop but was unable to do so. The collision caused the truck to jackknife and come to rest in the median, while the van crossed the median and struck a guard rail in a northbound lane of 390. An investigation is continuing. Stolen car chase ends in arrest A 22-year-old Rochester man was arrested early yesterday and charged with driving a stolen car after a high-speed chase down East Ridge Road in Irondequoit. Then of 75 Tyler St. was arrested about 3 a.m. after losing control of his vehicle near North Clinton Avenue and striking a traffic signal box. Then was charged with fourth-degree criminal possession of stolen property. More charges are pending.
